ZIKIWA zimesalia miezi 11 kabla ya uchaguzi mkuu wa Agosti 10, 2027, vita vya kisheria kuhusu kuwepo kwa Kituo cha Kitaifa cha Kuhesabu Kura za Urais (NTC) vimeanza kushika kasi, huku macho yakielekezwa kwa Tume Huru ya Uchaguzi na Mipaka (IEBC). Mahakama Kuu inatarajiwa kutoa uamuzi kuhusu uhalali wa kikatiba wa NTC Septemba 22, 2026, kufuatia kesi zilizowasilishwa na Seneta wa Busia Okiya Omtatah pamoja na viongozi wa upinzani wakiongozwa na kiongozi wa Wiper Kalonzo Musyoka na mwenzake wa DCP Rigathi Gachagua. Walalamishi wanataka mahakama itangaze kuwa kuanzishwa na kuendesha NTC kwa ajili ya kuthibitisha tena matokeo ya urais ni kinyume cha Katiba, na hivyo kubatilishwe. Wanadai kuwa katiba inaweka eneobunge kuwa kituo cha msingi na cha mwisho cha kuhesabu, kuthibitisha na kutangaza matokeo ya urais. Wanaopinga NTC pia wanataka IEBC izuiwe kuhesabu tena au kubadilisha matokeo yaliyotangazwa na maafisa wasimamizi wa uchaguzi wa maeneobunge. Aliyekuwa Jaji Mkuu David Maraga ameunga mkono wito wa kuondolewa kwa NTC. "Katiba haitoi nafasi kwa kituo cha kitaifa cha kuhesabia kura. Jukumu la IEBC ni kutangaza matokeo, wala si kuhesabu kura tena," akasema Maraga. Hata hivyo, msimamo huo unatofautiana na uamuzi wa Mahakama ya Juu katika kesi ya uchaguzi wa urais wa 2017. Mahakama hiyo ilisema IEBC ina jukumu la kujumuisha na kuthibitisha kura kabla ya kutangaza mshindi, huku mchakato huo ukiendelea kutoka kituo cha kupigia kura hadi eneobunge na hatimaye NTC. Katika kesi ya 2022, Mahakama ya Juu ilifafanua kuwa jukumu la kuhesabu na kuthibitisha matokeo katika NTC ni la IEBC kama taasisi, huku mamlaka ya kutangaza mshindi yakiwa ya mwenyekiti wa tume. Aliyekuwa Mwanasheria Mkuu Justin Muturi na aliyekuwa rais wa Chama cha Mawakili (LSK) Nelson Havi pia wameunga mkono kuondolewa kwa NTC, wakisema matokeo yaliyohesabiwa na kutangazwa katika maeneobunge 290 yanapaswa kuwa ya mwisho. Kwa upande mwingine, aliyekuwa kamishIna wa IEBC Paul Kurgat anasema Katiba haijaweka jengo maalumu kuwa kituo cha kuhesabia kura, bali inasimamia mchakato. Anasema Kanuni za Uchaguzi zinahitaji kuhesabiwa kwa kura kikamilike katika kituo kilichotangazwa rasmi na IEBC. Mzozo huo sasa unahusu zaidi ya eneo la Bomas, kwani kesi hizo zinahoji iwapo IEBC ina mamlaka ya kikatiba na kisheria kuthibitisha matokeo ya urais katika ngazi ya kitaifa baada ya kutangazwa katika maeneo bunge. Kwa kuzingatia uwezekano wa suala hilo kufikishwa Mahakama ya Juu, uamuzi wa Mahakama Kuu unaweza kuwa hatua ya kwanza katika vita virefu vya kisheria kuhusu mfumo wa kuhesabu na kuthibitisha matokeo ya urais kuelekea uchaguzi wa 2027.
