Korti yakataa kuondolea wasaidizi wa Ruto kesi ya Apu ya siri ya kuwinda wakosoaji wa serikali
MAHAKAMA Kuu imekataa kufutilia mbali kesi inayodai kuwa maafisa wakuu serikalini walihusika katika mpango wa kutafuta apu ya siri ya kidijitali kutumiwa kufuatilia viongozi wa upinzani, kudhibiti ukosoaji dhidi ya serikali kwenye mitandao ya kijamii na kuboresha taswira ya utawala wa Rais William Ruto. Katika uamuzi wake, korti ilisema madai hayo ni mazito na yanastahili kusikilizwa kikamilifu katika kesi kamili badala ya kutupiliwa mbali katika hatua za awali za mchakato wa korti. Mahakama ilitupilia mbali maombi tofauti yaliyowasilishwa na Katibu wa Wizara ya Fedha Chris Kiptoo, Mkuu wa Utumishi wa Umma Felix Koskei, Mwanasheria Mkuu Dorcas Oduor na mfanyabiashara Jayesh Saini waliotaka majina yao yaondolewe kwenye kesi iliyowasilishwa na mtaalamu wa kuunda apu Mary Wachuka pamoja na kampuni yake ya Jipe Inc wakitaka wafidiwe Sh291 milioni. Kutokana na uamuzi huo, kesi hiyo ya kibiashara itaendelea kusikilizwa. Kiini chake ni madai kwamba maafisa wakuu serikalini walitaka kuundiwa mfumo wa siri wa mawasiliano ya kidijitali lakini baadaye wakaachana na mradi huo, jambo ambalo linadaiwa kumsababishia Bi Wachuka hasara kubwa. Washtakiwa wote wamekanusha madai hayo wakisisitiza kuwa hakukuwa na mkataba wowote halali kati yao na mlalamishi. Kwa mujibu wa hati za kesi, Bi Wachuka anadai kuwa mwishoni mwa mwaka 2023 aliombwa kuunda mfumo huo wa kidijitali baada ya kufanya mazungumzo na Eric Ng'eno, aliyekuwa mwandishi wa hotuba za Rais William Ruto wakati huo. Anasema baadaye alitia saini mkataba na kampuni ya teknolojia ya Amerika, Tesxo, kuunda mfumo huo chini ya mradi uliopewa jina la siri "Numera 2023". Hata hivyo, anadai serikali haikutekeleza ahadi zake za kifedha, hali iliyomfanya ashindwe kumlipa mkandarasi huyo na hivyo kukabiliwa na adhabu ya kukiuka mkataba. Katika hati zake, Bi Wachuka anadai alielezwa kuwa mradi huo ungefadhiliwa kupitia fedha za siri za Wizara ya Fedha na kwamba Bw Saini ndiye angesimamia utoaji wa fedha kutokana na usiri wa mradi huo. Madai hayo yanapingwa na washtakiwa. Mahakama ilisema kuwapo kwa Bw Kiptoo na Bw Koskei katika kesi hiyo ni muhimu kwa kuwa madai dhidi yao yanahusu hatua au kutokuchukua hatua kunakodaiwa kulisababisha walalamishi kuingia kwenye mradi huo. "Kuwepo kwa washtakiwa wa kwanza na wa pili kutaiwezesha mahakama kubaini iwapo Serikali ya Kenya kupitia maafisa wake ilitoa maelezo yaliyowafanya walalamishi kuchukua hatua zilizowasababishia hasara," ilisema mahakama. Jaji alisisitiza kuwa katika hatua hiyo mahakama haikuwa inaamua kama madai ya mlalamishi ni ya kweli au la, bali ilikuwa inachunguza iwapo kuna hoja zinazostahili kusikilizwa katika kesi kamili. Mahakama ilisema mfumo wa sheria unataka kila upande upewe nafasi ya kusikilizwa na mgogoro kuamuliwa kwa kuzingatia ushahidi wote utakaowasilishwa. Baada ya kupitia madai ya Bi Wachuka pamoja na vielelezo vilivyowasilishwa, ikiwemo mawasiliano ya WhatsApp, jaji alisema walalamishi wamewasilisha hoja zinazotosha kuhalalisha kuendelea kwa kesi hiyo.
